Title 17 CCR §54327 — Approved June 11, 2025 · Effective May 1, 2026. When in doubt, report within 24 hours and update as more information becomes available. Filing with APS/CPS/law enforcement does NOT replace an SIR to the regional center.

Overview & Decision Rule

Two categories — always reportable vs. under vendored care only

ALWAYS REPORT — regardless of when or where

Any death of an individual served
Any crime the individual was a victim of
Any mandated APS, CPS, ombudsman, or law enforcement report filed for abuse or neglect

UNDER VENDORED CARE — report if incident occurred while vendor was responsible

Missing person (reported to law enforcement)
Reasonably suspected abuse (any type)
Abusive restraint use
Reasonably suspected neglect
Serious injury or accident
Unplanned hospitalization (qualifying condition)
Emergency room stay 5+ days

"Under Vendored Care" means: vendor was actively providing services, OR was listed in the IPP as responsible for services at the time, OR provides 24/7 care (SLS, FHA, FMS) — meaning all incidents that individual experiences are always reportable regardless of whether staff were physically present.

Who Is Exempt from Reporting

Not all vendors are required to file SIRs

Exempt — no SIR required

✗Parent vendors — parents vendored to provide services to their own child

✗Self-vendored individuals — individuals vendored to provide services to themselves

✗Participant-directed service providers — not vendored by a regional center

Required to report

✓Financial Management Service (FMS) providers — ARE required to report even though they support participant-directed services

✓All other vendored providers — including SLS, ILS, day programs, employment services, transportation vendors, long-term health care facilities

Important: Vendors must report incidents that likely occurred while under vendored care — not just those that occurred while the individual was specifically under their own vendored care. Regional centers must also report to DDS any incident they learn about, even if the vendor has not yet filed.

Death (Mortality)

Universal — always report regardless of cause, location, or timing

ALWAYS REPORT +

Any death of an individual served — regardless of cause

Includes deaths at a hospital, during a home visit, while on leave, or in any setting. The vendor must report it as soon as they learn of it.

Universal — includes all crimes, not just those listed

Attempted or actual homicide or manslaughter · Human Trafficking · Stalking · Hate Crime

Do NOT wait for formal charges. Report if the individual (or vendor) believes a crime occurred. Corroborating information includes: 911 call record, incident report number, case number, confirmation from law enforcement, or witness account. If the incident is later confirmed not to be a reportable event, withdraw the report.

Reg ref: Title 17 §54327(c)(2). New crimes added in 2025: Simple Assault, Battery, Fraud, Identity/Credit Theft, Attempted Homicide/Manslaughter, Human Trafficking, Stalking, Hate Crime.

Mandated APS / CPS / Ombudsman Reports

Universal — any time a mandated report is filed, an SIR is also required

ALWAYS REPORT +

Adult Protective Services (APS) report filed under the Elder & Dependent Adult Abuse Reporting Act (WIC §15600)

Child Protective Services (CPS) report filed under the Child Abuse & Neglect Reporting Act (Penal Code §11164)

Long-term care ombudsman or law enforcement report for suspected abuse or neglect

Filing with APS/CPS does NOT satisfy your SIR obligation. A separate special incident report must also be submitted to the regional center having case management responsibility.

NEW in 2025: This is now a universal reporting trigger — applies regardless of whether the individual was under vendored care at the time.

Missing Person

Under vendored care — when law enforcement is contacted

UNDER VENDORED CARE +

Vendor communicated with any law enforcement agency and described the individual as missing

A formal missing person's report does not need to be completed by law enforcement — any communication describing the individual as missing is sufficient.

Individual returned by police and their absence was inconsistent with the supervision level in their IPP

If the IPP allows the individual to be in the community unsupervised, this is NOT reportable as missing.

Reasonably Suspected Abuse

Under vendored care — 8 types plus mandated reports

UNDER VENDORED CARE +

Physical Abuse — any intentional act of bodily contact that causes injury or trauma

Sexual Abuse — non-consensual touching of intimate parts; manipulation/coercion into sexual acts

Financial Abuse — taking/retaining assets wrongfully; mismanagement of SSI/P&I funds by rep payee; undue influence. No fiduciary relationship required.

Emotional / Mental Abuse — threats, intimidation, harassment, deceptive acts with malicious intent to frighten or cause serious emotional distress

Exploitation — forcing/compelling individual into prostitution, obscene sexual conduct, or obscene depictions

Verbal Abuse — words, gestures, or other communication used to purposefully threaten, intimidate, harass, or humiliate

Example: driver telling individual to "move their fat ass" or making demeaning gestures.

Isolation & Seclusion — blocking mail/calls, false statements to visitors, false imprisonment; or involuntarily confining individual alone in a locked/blocked room

Seclusion is prohibited for all individuals with developmental disabilities. Any use = reportable abuse.

Mandated APS/CPS report filed — triggers SIR regardless of vendored care status (see Mandated Reports section)

Reasonable suspicion is enough. You do not need confirmation. For adults 18–64 or elders 65+: an objectively reasonable suspicion based on facts. For children under 18: same standard under the Child Abuse and Neglect Reporting Act.

Restraint Use (Abusive)

Under vendored care — only when one of four conditions is met

UNDER VENDORED CARE +

Report restraint use only when ANY of these is true

Technique inconsistent with the program's approved plan, restraint training curriculum, or restraint policy

Used when no imminent risk of harm — restraint applied in response to behavior that did not pose imminent risk

Not approved in individual's current IPP plan — restraint is part of the plan but the specific restraint used is not an approved intervention

Chemical or mechanical restraint inconsistent with physician's order

Types: Physical (manual hold restricting movement), Mechanical (device/material attached to body restricting movement), Chemical (involuntary medication to sedate/control behavior — not a standing/regularly-prescribed medication).

Not all restraint use is reportable — only when one of the four conditions above is met. For all other restraint reporting obligations under §50802 and WIC §4659.2, see DDS Direction G-2025-Reporting Requirements-002.

Reasonably Suspected Neglect

Under vendored care — 6 failure types plus self-neglect and mandated reports

UNDER VENDORED CARE +

Negligent failure to…

Provide medical or dental care for physical and mental health needs — including failing to administer required health care interventions (e.g. dressing changes, compression hose)

Prevent malnutrition or dehydration

Protect from health and safety hazards — including failing to prevent two or more falls within 30 days

The 30-day window starts on the first fall. Falls across different providers count — e.g. if a day program staff knows of a fall at SLS two days earlier, they report the second fall as neglect.

Assist with personal hygiene — including failure to assist with toileting, incontinence needs, and provision of food, fluids, clothing, or shelter

Exercise reasonable care — failure to exercise the degree of care a reasonable person in a like position would exercise

Abandonment — leaving individual without necessary supports when a reasonable person would continue care (e.g. staff leaving before relief arrives)

Also applies when parents refuse to permit son/daughter to return home after hospitalization with no alternative housing arranged.

Self-neglect — adult individual's failure to exercise self-care that a reasonable person in a like position would exercise

Minor becomes pregnant — file a report of suspected abuse or neglect

Reg ref: Title 17 §54327(d)(3). New in 2025: medical/dental care, 2+ falls in 30 days, hygiene/toileting, abandonment.

Serious Injury / Accident

Under vendored care — 15 defined types; not exhaustive

UNDER VENDORED CARE +

Always reportable (no medical threshold required)

Lacerations requiring sutures, staples, wound adhesive, or other closure beyond first aid

Fractures or Dislocations

Bruising, contusions, or hematomas to: head, eyes, or neck (any size) · breasts, genitals, rectal/anal area (any size) · any body area 2 inches or greater

Bruises are separate from internal bleeding and must be reported independently.

All medication errors — wrong medication, wrong dose (including missed doses), wrong time, wrong route. Individual refusing medication is NOT an error.

Pressure injuries stage 2 or greater, or unstageable

Reportable when requiring medical treatment beyond first aid

Puncture wounds · Bites that break the skin · Internal bleeding · Medication reactions · Burns · Injury from a seizure · Injury from aggressive contact by another individual served

Reportable when requiring medical attention (assessed/observed by a professional)

Any head injury, including concussion — reportable if seen by any trained medical professional, even if no further treatment was given

Medical Treatment Beyond First Aid: treatment by a trained professional beyond one-time, short-term treatment given immediately at the injury location.
Medical Attention: individual is assessed or observed by a trained medical professional (lower bar than treatment).
Attack by staff or public = battery (crime), not serious injury. Attack by another individual served = serious injury.

Reg ref: Title 17 §54327(d)(4). New in 2025: bruising thresholds, head injury requiring medical attention, pressure injuries, aggressive contact injuries.

Unplanned / Unscheduled Hospitalization

Under vendored care — 9 qualifying medical conditions

UNDER VENDORED CARE +

Report if hospitalization is related to any of these conditions

Respiratory illness — asthma, tuberculosis, COPD, and others

Seizure-related

Cardiac-related — congestive heart failure, hypertension, angina, and others

Internal infections — ear, nose, throat, gastrointestinal, kidney, dental, pelvic, urinary tract

Diabetes — including diabetes-related complications

Wound/skin care — cellulitis, decubitus, and others

Nutritional deficiencies — anemia, dehydration, and others

Bowel obstruction

NEW in 2025 — previously not a reportable condition.

Involuntary psychiatric admission — non-conserved adult who did not consent or admitted by court order/WIC §5150; conserved adult where conservator did not consent; child where parent/guardian did not consent

5150 evaluation in the ER that does NOT result in admission is NOT reportable. Admission to state-operated facility is NOT reportable.

Do NOT wait for a discharge diagnosis. File the SIR within 24 hours of learning the hospitalization is related to a reportable condition. If later confirmed to be non-reportable, withdraw the report.

Reg ref: Title 17 §54327(d)(5). "Hospitalization" = admitted as inpatient regardless of duration.

Extended Emergency Room Stay

Under vendored care — 5 or more calendar days in the ER

UNDER VENDORED CARE +

Individual remains in an emergency room for 5 or more calendar days

Example: arrived Friday 10:30 PM → still in ER through Tuesday = reportable (Friday, Saturday, Sunday, Monday, Tuesday = 5 calendar days).

NEW in 2025 — this is an entirely new reporting requirement. Reg ref: Title 17 §54327(d)(6).

Multiple Types or Series of Incidents

One report per incident day — one report per individual per event

One event, multiple types → one report, check all applicable types (e.g. missing + serious injury)

One event, multiple individuals → one report per individual (e.g. 3 people injured in a vehicle accident = 3 SIRs)

Same incident across multiple days → one report for the series (e.g. wrong medication dose for 9 consecutive days = one SIR noting 9 errors)

Two different incidents, same day, unrelated → two separate reports

Same incident type on two different days → two separate reports (e.g. missing person two days in a row = 2 SIRs)

What to Include in the Report

Required fields per Title 17 §54327(g)

Vendor/facility name, address, and telephone number

Date, time, and location of the incident

Name and date of birth of the individual served

Names of any other individuals served involved in the incident

Description of the incident

Description of alleged perpetrator(s) — age, height, weight, occupation, relationship — if applicable

Treatment provided to the individual, if any

Names and addresses of any witnesses

Actions taken by vendor, individual, or other agencies in response

Law enforcement, licensing, protective services, or other agencies notified or involved

Family members or authorized representative contacted and informed

Include as much as is known at the time. Update the report as more information becomes available. If uncertain whether an incident is reportable, file the initial report within 24 hours and correct or withdraw it if later confirmed non-reportable.
